The Memoirs Of Justice Nasim Hasan Shah
The book of the former Chief Justice of Pakistan Justice Nasim Hasan Shah has been published and the Book Traders has posted on Facebook its advertisement. Respected justice was physically a small statured person, but sorry to say that inwardly, he also proved to be a small man. He confessed in his life that he and the other judges of the Supreme Court gave capital sentence to Zulfiqar Ali Bhutto under duress; that they were pressurized by the military dictator General Zia-ul-Haq. When Rod rules over Reason, it means the death and destruction of that nation.
General Zia-ul-Haq betrayed Mr Bhutto and stabbed in his back. He revoked constitution and ruled over Pakistan by flogging the political opponents and incarcerated them for years and years. He involved Pakistan in the internal fight of Afghan groups and the aftermath of this fight was the plight of Heroin trade, sectarian extremism and Kalashnikov culture which totally devastated and destroyed the peaceful culture of Pakistan. He exploited Islam and deluded the nation. To support or obey such a ruler is tantamount to hypocrisy and heresy. Justice Nasim Shah played in the hands of a dictator and become a tool to hang the greatest visionary and revolutionary leader of Asia, Mr Zulfiqar Ali Bhutto. History will never forgive him and his colleagues who stifled justice.
Once, I met him in the book launching ceremony of the book titled “اقبال اور اسلامی معاشرہ” (Iqbal and Islamic Society) written by Late Altaf Hussain Advocate. The function was held in Islamabad Hotel, Islamabad. Justice Nasim Shah had presided over the function. I was the key note speaker. He admired my speech and my zeal and zest for the message of Dr. Iqbal. He was a man with smiling face and cordial attitude. I have no personal grudge against him. As a judge, he had good reputation. He was just, judicious, honest, and efficient judge. But, he had no moral courage to decline and cast off the ambition of a general who pressurized him to succumb before his wish.
He was one of the judges, who were part of bench of the judges of Supreme Court who ordered to hang a great visionary leader of Pakistan Shaheed Zulfiqar Ali Bhutto. It was a judicial murder. My book titled “The Ideals of Bhutto”, which I had written at the wish of Ms Benazir Bhutto, was published by National Book Foundation, Islamabad. It throws ample light on the conspiracy hatched by General Zia and the judges to hang Mr Bhutto. Judicial murder of Bhutto and the confession of Justice Nasim Shah raise radical alarming questions.
Justice Munir did injustice with justice by introducing the fake philosophy of “Law of Necessity.” Justice Iftikhar Chaudhry also legalized the Martial law of General Pervez Musharraf. The role of judiciary has been made very bleak by the judges who gave legal sanction and protection to martial laws. What is happening to date in the courts? Why the High courts and the Supreme Court are being discussed in public? Is it good for justice and judiciary? If the contempt of court is a punishable crime, then how about the judges who play with justice?
I salute those judges who give decisions according to law and constitution. They are our pride. In an Islamic state, a judge owes sacred duty to do justice without fear or favour. The judges must be the men of conscience and integrity, otherwise, the legal system is bound to collapse. I am remembered of a great judge of integrity and honesty whose name is Justice Rustam Kayani. He was a literary and scholarly figure as well. His book titled “ افکارِپریشاں”(Stray Reflection) is a marvellous literary book. Once the President of Pakistan Field Martial Ayub Khan phoned him and expressed annoyance on bailing one politician. The great justice retorted:
“Mr President, heaven wouldn’t fall down on bailing out a politician.”
He was a man of courage and conviction. We need judges like Justice Rustam Kayani; we do not need judges like Justice Nasim Shah, who later repent on their wrong decisions made under duress.
